g. No third-party beneficiaries. There is no third party beneficiary of this agreement. Downtime is defined as a period during which end users are not able to see the state of presence, perform instant conversations, or initiate online conversations. This Agreement is the whole agreement on its subject matter and supersedes all prior or simultaneous notifications.

In the event of any conflict between the documents in this Agreement that is not explicitly resolved in these documents, their terms apply in the following descending order of priority: (1) this Microsoft Online Subscription Agreement, (2) the Online Terms of Service, (3) the details of the current offer, and (4) all other documents in this Agreement. This Microsoft Online Subscription Agreement is between the legal entity you represent or, if you do not designate a legal entity in connection with a subscription purchase or subscription renewal, you individually (“you” or “your”) and Microsoft Corporation (“Microsoft”, “we”, “us”, “us” or “unser”). It consists of the online terms and conditions of service, SLAs and offer details for your subscription or renewal (together the “Agreement”). (i) For engagement offers, the price tier may be based on the quantity of online services you have ordered. Some offers may allow you to change the amount of online services ordered over the lifetime and your price level may be adjusted accordingly, but price level changes are not retroactive.

During the term of your subscription, the prices of the online services in relation to your subscription will not be increased from the prices published on the portal on the effective date or renewal of your subscription, unless the prices are indicated in the offer details as temporary or for previews or non-Microsoft products. . . .
